What steps can I take to undue a marriage where the spouse is not divorsed from her previous husband?


I have been married since 1990 and separated since 1992. My wife never obtained a divorse from her husband before we married. I want to end this marriage what steps do I take?

If she was not divorced, then you are not married, and she has committed the crime of bigamy.

Since you were not married, you need to do nothing.

Just walk away buddy technically your not married. My grandfather did this to my grandmother and it was hilarious. He left her and moved in with another lady and filed for divorce. Before my grandparents divorce was finalized he married the other woman. A judge ruled his second marriage null and void because he was not legally seperated from grandma yet and he had to turn around and marry the second wife again.....it was hilarious!!!

Technically your not married but that might need to be put on paper for the bureaucrats, I don't know if your lady thought she was divorced and found out later that she really wasn't, but whatever steps you choose to take could result in her being prosecuted for bigamy. A lawyer should resolve/disolve the matter rather quickly.

First, why are you concerned about the fact that she was already married when you got married 18 yrs ago. For the last 16 yrs it has not been an issue, so why now?

Just go get your divorce from her and stop trying to stir up trouble over the fact that you were sleeping with another man's wife for 2 yrs.

She is not legally married to you now, just so you know. She is still legally married to him. She can file divorce by publication and put an ad in the local newspaper if she cannot find him now. Then you'll have to remarry her after that for your marriage to be legal.

well i believe that since your "wife" is still married according to the law, your "marriage" is null and void. your "wife" could be found guilty of being married to two men at the same time *reverse polygamy*.

They actually 'voided' the marriage, so it's like it never existed. It isn't the same as an annulment. Perhaps they have the same thing in your state. If not, you can have it annulled anyway.

Well technically you are not legally married anways, you can go to the court house and get the papers riped up. And she will probably go to jail. but you can EASILY have it done by going to the court house

If you're in the US, you're not legally married. Cause your wife is still legally married to her first husband. A person can't legally be married to two people at the same time.

you really need to ask that question where you received your marriage license. as i understand the law if one partner is married already the second marriage isn't valid.

you shouldn't have to do anything since you are not really married. If she wasn't divorced then legally you guys aren't married.

You don't need to take any steps you aren't legally married. the woman you want to undoe with has broken a law by marrying when she was still married. don't worry about it

If she was never divorced from her previous hubby when you married her then your marriage is not legal so you don't need a divorce.

Your marriage is anull and void. She can not be married to two people at one time. So hire an attorney or simply go down to city hall and resolve it yourself. It will be like you never married.

If what you say is 100% accurate then your marriage was never legal to begin with. So you get off on a technicality.

File a police report charging this woman with bigamy then hire yourself a good lawyer!
